File these stories under “This week in Justice Delayed/ relative progress/ baby steps/ Black Lives Matter a Little” news: a Black woman who never should have been convicted for firing a warning shot to scare off an abusive husband is “allowed” to serve the rest of her sentence at home under house arrest. And a judge threw out the convictions of 9 Black men who had sat at an all white lunch counter in Rock Hill, South Carolina in 1961.

Marissa Alexander was sentenced to 20 years in jail for shooting a wall and harming nobody. She was attempting to scare off her abusive then-husband, Rico Gray, who had admitted to and against whom she had a restraining order. Thinking he was not at home, Alexander went to their former house to get some belongings. The two got into an argument and, according to Alexander, Gray threatened her. Gray corroborates Alexander’s story: “I was in a rage. I called her a whore and bitch and … I told her … if I can’t have you, nobody going to have you,” he said, in a deposition. When Alexander retreated into the bathroom, Gray tried to break the door. She ran into the garage, but couldn’t leave because it was locked. She came back with a registered gun, which she legally owned, and yelled at him to leave. Gray recalls, “I told her … I ain’t going nowhere, and so I started walking toward her … I was cursing and all that … and she shot in the air.” Gray himself understands why Alexander fired the warning shot:

Apparently, Bill de Blasio disrespects police because he has bi-racial children and acknowledges racism

The other day, something I wrote here– If ‘Black Lives Matter’ killed NYPD officers, Tea Party killed Las Vegas police–caused a not very surprising or remarkable Facebook fight, which evolved into a debate over Bill de Blasio’s role in and response to the murders of two NYPD officers.  After people accused Bill de Blasio of being part of the problem and failing to do his job, I commented,

After I review the evidence, I will offer advice to the Mayor on how he can best move forward and redeem himself.

First, what exactly did Bill de Blasio say that has landed him in so much trouble. On December 3, after a StatenIsland grand jury decided not to indict the officer whose chokehold killed Eric Garner, de Blasio said that he was “astonished by the decision” and that it was a  “very painful day for so many New Yorkers.” De Blasio also made the following unspeakable comments about how he and his wife Chirlane have worried about the safety of their son, Dante:

‘I can’t breath,’ ‘please don’t let me die,’ and other last words of police brutality victims

“I can’t breath, I can’t breath, I can’t breath, I can’t breath, I can’t breath, I can’t breath, I can’t breath, I can’t breath, I can’t breath, I can’t breath, I can’t breath.” Those were the last words uttered by Eric Garner. He told the police who was holding him in a chokehold eleven times that he couldn’t breath. Yet the policeman, Daniel Pantaleo, kept his arms around his neck and, perhaps even more appallingly, neither the police nor the EMT even attempted to revive Mr. Garner who lay on the ground for seven minutes.

Shirin Barghi, a filmmaker from Iran and based in New York City took the last words of Eric Garner as well as other unarmed Black men killed by law enforcement and turned them into very minimalist images that are truly heartbreaking.

More Americans have been married to Kim Kardashian than have died from Ebola

This meme, which points out that three Americans have been married to Kim Kardashian and only American has died of the virus helps put the Ebola hysteria into perspective.

But the point isn’t to trivialize Ebola. The point is that, as per usual, politicians and the media are distorting reality, manipulating people’s fears and ignoring the important stories and lessons that could– and should– come out of the Ebola tragedy.

The Ebola virus has highlighted the dangers of neo-liberal policies, which destroy public infrastructure, and a myopic privatized health care system in which saving lives is less important that making huge profit. It has revealed the way the death of Africans is acceptable while the death of Americans and Europeans, especially white ones, is not. As Dr. Atul Gawande explained on Democracy Now! it was only when the disease traveled from Africa to the U.S. that people started paying attention:

 Starting at March 31st, Doctors Without Borders said the hospitals in Guinea and in Liberia are overwhelmed, and they were crying for help. As late as September 2nd, they were telling the U.N. and others that the help being provided is a shambles, that this is a disease that is doubling in the number of cases every three weeks. And our response was pathetic.

It might have been the best thing that has happened that the first case to leave the African continent came to America, because it brought our mobilization to realize what happens there matters to us here. And suddenly, we are now mobilizing thousands of people to go. The CDC has mounted the largest global operation for public health in U.S. government history.

It shows us that we live in a world where epidemics are manipulated for political gain, to make far-fetched racist and outlandish claims about Obama’s alleged loyalty to Africa over America  and used to further racist and totally incoherent and illogical claims about Mexican Immigrants bringing Ebola into the country.  Be xenophobic and racist. Go ahead. But at least make your racist and xenophobic lies have an air of credibility.

We Shall overcome: the lesbian sperm bank remix

Most women who, for whatever reason, cannot become pregnant on their own, are thrilled artificial insemination enables them to have a child. But Jennifer Cramblett, of eastern Ohio is so upset about her daughter, she’s suing the sperm bank. Why? Because the sperm bank accidentally mailed her sperm from a black donor. And that means that Cramblett’s two-year-old daughter, Payton, is… wait for it… bi-racial.

As David Ferguson reported on,  this is something Cramblett, who had requested a white man’s sperm, didn’t want. So, she’s suing the Midwest Sperm Bank, which mixed up the sperm batches when it read a vial labeled  380 as 330. According to her lawsuit and attorney, Cramblett should be compensated so she can move because she lives in an intolerant town, has an intolerant family and intolerant friends. Attorney Thomas Intili said, “she lives in an all-white community in eastern Ohio. She did not encounter any African-American people until she entered college. Not all her friends and family members are racially sensitive.” Perhaps most painful of all is that Cramblett is forced to travel a long distance to get her daughter a semi-decent haircut. The lawsuit reads,

Getting a young daughter’s hair cut is not particularly stressful for most mothers, but to Jennifer it is not a routine matter, because Payton has hair typical of an African American girl. To get a decent cut, Jennifer must travel to a black neighborhood, far from where she lives, where she is obviously different in appearance, and not overtly welcome.

It’s bad enough to have to shlep to a hair dresser who can disentangle the mystery that is African American girl hair. On top of that, it seems, Cramblett risks her life every time she ventures into a neighborhood where she is “othered” by African Americans who, presumably, commit hate crimes against her with their eyes.

LGBT people are not, actually, all billionaires who brunch 24/7

Hardcore homophobes and playful pop culture often present the gays, especially gay men, as brunch-eating, artisanal cocktail swigging, shopping-spreeing, swinging singles with disposable income. Shockingly, this is a myth and not reality.

new report from the Movement Advancement Project and Center for American Progress shatters the myth and reveals that LGBT actually are worse-off financially than their hetero brothers and sisters. For instance, while  39% of non-LGBT adults in the U.S. report they are thriving financially, only  29% of LGBT adults do. While 17% of non-LGBT people who live alone make less than $12,000 a year, 20.7% of LGBT people living alone earn less than $12,000. Transgender people are almost four times as likely to earn less than $10,000 than the rest of the population even though transgender people have much higher rates of college and graduate school education. Single LGBT people with children are three times more likely to be living near the poverty line than the rest of the population with children. And married or partnered LGBT parents are twice as likely to earn incomes close to the poverty line than married or partnered non-LGBT parents. Children raised by same-sex couples are nearly twice as likely to live in poverty than are children raised by married heterosexual couples.

And then, of course, there’s ye ole racism, which dovetails beautifully with homophobia. So, for instance, African Americans in same-sex couples are more than twice as likely to live in poverty as African Americans in married male-female relationships.

The study lays out the three main causes of the financial disadvantages faced by LGBT people:

1. Lack of protection from discrimination means that LGBT people can be fired, denied housing, and refused medically-necessary healthcare simply because they are LGBT. The financial penalty: LGBT people can struggle to find work, make less on the job, and have higher housing and medical costs than their non-LGBT peers. 2.Refusal to recognize LGBT families means that LGBT families are denied many of the same benefits available to non-LGBT families when it comes to health insurance, taxes, vital safety-net programs, and retirement planning. The financial penalty: LGBT families pay more for health insurance, taxes, legal assistance, and essential protection for their families in times of crisis. 3. Failure to adequately protect LGBT students means that LGBT people and their families often face a hostile, unsafe, and unwelcoming environment in local schools, as well as discrimination in accessing financial aid and other support. The financial penalty: LGBT young people and the children of LGBT parents are more likely to perform poorly in school and to face challenges pursuing postsecondary educational opportunities. This, in turn, can reduce their earnings over time, as well as their chances of having successful jobs and careers.

See the infographic of this information below. So, this is the terrible news. But the good news is that we know how to fix the problem. Pass anti-descrimination legislation. I know this seems terrible unjust to those who equate family values with forcing parents and their children to live in poverty. Oh well. They’ll have to get over that.

Cop who killed young Black man with dreads warned of Rasta drug culture

The same cop who shot and killed a 21-year-old Black man who wore dreadlocks had a lot to say about the nefarious connection between drugs and Bob Marley music.

Corporal Matthew Schauerhamer of Saratoga Springs, Utah, is one of the two police officers who were involved in the shooting and killing of Darrien Hunt, which took place last week. The police claimed they shot Hunt as he lunged at them with a samurai sword. The Prosecutor initially backed up the claim but has since stated that Hunt was actually dozens of yards away when he was shot multiple times and killed. An independent autopsy and witnesses corroborate not only that Hunt was far away from police, but that he was running away and shot from behind.

It has been revealed by The Guardian that in June of this year Schauerhamer, 32, had written an article in the local newspaper offering parents tips on how to figure out if their kids are into drugs:

If parents are able to familiarize themselves with the specific trends of drug culture, they will be more likely to recognize if their child is descending into the culture and subcultures that drug users associate with. It will be easier for parents to distinguish whether their child is using or associating with people who use drugs.

According to Schauerhamer’s helpful guide, which was published in a local newspaper in June, one of the gate-way subcultures into drugs is “Rasta” culture.

 if your child is listening to Bob Marley’s “Kaya” is wearing a Bob Marley shirt with Bob Marley on it smoking a joint, has a Bob Marley poster in his room, and is wearing a Rasta hat (red, yellow and green), it is highly likely your child is highly high. If they have Rasta colored anything, it is a good bet your child uses or hangs out with drug users.

Nor does the officer shy away from overstating the allegedly indestructible link between style and criminality. He actually writes that,

the spade associated with this [SRH] clothing brand is so mainstreamed now that simply wearing it makes you a walking billboard proclaiming to the police, ‘I use drugs! Arrest me now!’

Urban Outfitter’s greatest racist, sexist, tasteless hits

This week Urban Outfitters sold a great sweatshirt. It said Kent State and had, what appeared to be a blood stain. Everybody except, allegedly, Urban Outfitters saw the sweatshirt as a reference to the blood-stained history of Kent University where, in 1970, the National Guard killed four students and injured 10. Urban Outfitters released an apology, via Twitter, which is really huge. And then they came out with another apology which was surprisingly honest in its acknowledgement of how little their word counted:

this truth does not excuse us from our failure to identify potential controversial products head on. We, as a company who caters to a college-age demographic, have a responsibility to uphold to our customers. Given our history of controversial issues, we understand how our sincerity may be questioned.

Because it turns out, Urban Outfitters has an amazing resume of offensive products under its belt. And to be fair, they take diversity really seriously. They are an equal opportunity offender, whose products have mocked eating disorders, Jews, African Americans, Native Americans. I know I’m leaving someone out, so I apologize. Also, Ben Stein is nostalgic for when “lynchings of African Americans weren’t rare”

Ben Stein is a renaissance man. Famous for his role as the attendance-taking teacher in Ferris Bueller’s Day Off, he was also a game show host, a speech writer and lawyer for President Nixon and a philanderer. He is a man of contradictions. Socially conservative and in an open marriage. Jewish and doesn’t believe in evolution.

But when it comes to his racism, he’s extremely consistent. Recently, Stein gave an interview with Newsmax in which he totally, and unequivocally, exonerated not only the officer who killed Michael Brown, but the officer (who was actually not a policeman, and explicitly disobeyed police orders to stay in his car) who killed Trayvon Martin. For Stein, both Brown and Martin, not their innocent executioners, were the guilty ones.

Stein disputes the fact that Brown was not armed:  ”I mean he wasn’t unarmed; he was armed with his undoubtedly strong, scary self.” See! If he didn’t want to get shot, Brown shouldn’t have gone out with…. himself.

Also, if you want to not be executed by the police, simply change your tone.  In both the Martin and Brown case,

it’s the very large, so-called victim attacking the policeman who winds up dead…. I mean if they didn’t just, would not attack the policeman, if they would just talk to the policeman in a reasonable way instead of attacking the policeman, nobody would be dead.

(FYI, Trayvon Martin was 158 pounds. George Zimmerman weighs 178 pounds at the time. But, yes, Martin was taller. None of this is relevant but it just shows how Stein’s theory lack coherence and how is premise is not based on reality)

So, Ben Stein’s advice to young Black men: don’t leave the house because you are scary. But if you do… use your words.

Stein is concerned for the real victims and expressed fear that the Justice Department’s investigation into the killing of Brown would result, not in justice, but in a ”lynching jury.” Choice words.

Luckily, Stein doesn’t just use lynching as a metaphor. He addresses it literally:

There was a time, even in my youth … when lynchings of African Americans were not that incredibly rare. Now the lynchings are of the police, and it’s just an outrage!

Ahhh… the good old days. Before lynching of African Americans was replaced by the lynching of police officers. Not sure when any police officer in the United States was ever lynched. But it makes a great soundbite (lie).

St. Louis cops release incriminating video of fatal police shooting, think they look good

I have to applaud the police of St Louis. They are pretty powerful. Somehow, they managed to take  a video which captures a fatal, unjustified and unnecessary police shooting, and turn it into a video which, they claim, is “exculpatory” and proves that they were in the right.

In order to understand how they were able to transform the footage to suit their needs, let’s review what everyone agrees happened.

On Tuesday, in St Louis, fewer than four miles away from where the unarmed teenager Michael Brown was killed by police, a convenience store owner called 911 to report that a man, later identified as Kajieme Powell, had stolen pastries and energy drinks. Another woman called the police and said that Powell had a knife in his pocket and was behaving erratically. Two white officers arrived in an SUV. 23 seconds later, Powell, who was black, was dead on the ground, having been shot by the two officers.

On Wednesday, The St. Louis Police Department released footage recorded on a cell phone by a bystander. According to a police union representative, the footage released was “exculpatory.” In other words, the police decided to release the footage, along with the 911 calls, to show they had nothing to hide.

But let’s compare the footage of what happened and what the police claimed happened.

Police Claim: the police officers started shooting when Powell was within three or four feet of them.

Footage shows: Police started shooting before Powell was that close.
